Is this guy a criminal, or were his actions out of his control?
Here are two scenarios. Do you think Dave should be sentenced as a criminal or do you think he wasn't "fully morally responsible" for the event?
1. Dave is normally a quiet, gentle person, but he was hypnotized by an evil psychiatrist and ordered to kill Todd. While in a deep, hypnotic trance, Dave carried out the order.
2. Dave was having an affair with Todd's wife and wanted her husband out of the way. After weeks of planning and stalking Todd, Dave shot and killed him as Todd left his gym.
So what do you think? Should Dave be charged as a criminal or was he not fully responsible for his actions? Why or why not?The two scenarios are NOT related.
1. Hypnotism is essentially subliminal messaging in the way it works, so he would not be in a hypnotic state while committing a murder. It just wouldn't work. But in the case that he was subjected to a kind of subliminal messaging I would say he's not completely responsible and should be sent to a psychologial help facility to undo the damage, while the hypnotist should have his license revoked and sent to prison for the rest of his life. (This of course assuming that Dave has paperwork showing proof he was seeing a hypnotist.
2. Not even close to ethical. The fact the the murder was premeditated automatically makes him mentally unstable and he should either be sent to prison for the rest of his life or subjected to the death penalty. He has no right to kill someone for any reason except self-defense and if Todd's wife really cared about Dave, she would leave Todd. Simple enough.
